Terms of use

These terms are an agreement between you and Anvil Digital, a sole proprietorship in Ontario, Canada (“we”, “us”), for your use of SmartPark: the website, the mobile app and the services they provide (the “Service”). By using the Service you accept these terms. If you use it for an organization, you accept them for that organization too.

Licence

We give you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose while you have an account. You may not copy, resell, reverse engineer or try to get around the Service’s security or the limits of your role.

Accounts

Accounts are created by invitation from a property management company, condominium corporation, security agency or us. Keep your password private and tell us right away at support@anvildigital.ca if you think someone else has used your account. You are responsible for activity under your account.

Acceptable use

Your data

Information an organization puts into SmartPark belongs to that organization. We use it only to provide the Service, as described in our privacy policy. Organizations are responsible for having the right to collect the information they enter, including residents’ and visitors’ details.

Third-party services

Some features connect to services we don’t control, such as QuickBooks Online by Intuit. Your use of those services is governed by their own terms. Intuit doesn’t provide, endorse or support SmartPark, and isn’t responsible for it. We aren’t responsible for those services or for changes they make that affect the Service. You can disconnect a third-party service at any time.

Fees

Fees for organizations, if any, are set out in a separate agreement or order with us. Residents don’t pay to use SmartPark.

Availability and changes

We work to keep the Service available and secure but don’t promise it will be uninterrupted or error-free. We may change or improve features. We’ll give reasonable notice before removing a feature organizations rely on.

Disclaimer

The Service is provided “as is”. To the extent the law allows, we disclaim all warranties not stated in these terms, including fitness for a particular purpose. Invoices and figures the Service prepares, including taxes, should be reviewed by the organization that issues them.

Limitation of liability

To the extent the law allows, we aren’t liable for indirect, incidental or consequential losses, or for lost profits, revenue or data. Our total liability for any claim about the Service is limited to the amount the organization paid us for the Service in the 12 months before the claim, or $100 if nothing was paid.

Ending use

You can stop using the Service and delete your account at any time. We may suspend or close accounts that break these terms or put the Service or others at risk. Sections that by their nature should continue (such as Your data, Disclaimer and Limitation of liability) continue after use ends.

Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Disputes go to the courts of Ontario.

Changes to these terms

We’ll post changes here and update the date above. Continuing to use the Service after a change means you accept it.
